Bangladesh Regulation
Trade name is an important factor in Industrial Property Rights. The
theme of Trade Marks originated from Trade Name. In modern meaning Trade
Name is the word which the Company uses to name itself. It is actually
the Trade Name that makes a Company known to the world. The goodwill of
a Trade Name actually provides the information about the standard,
quality and popularity that a Company Product actually has. So it is
obvious that some people would like to trade upon on the goodwill of
popular Trade Names which initiates the necessity of protecting Trade
Names.
The Laws & Conventions
At present the laws of Bangladesh do not have sufficient provisions for
the Protection of Trade Names. Though, being a developing country,
Bangladesh is a member to the Paris Convention which implies that Trade
Names do not require to be registered for protection, Paris Convention
is not strictly followed by the Bangladesh Administration since, the
same has not been ratified in the Parliament. Further at present service
marks are not registrable yet and it worsens the situation further.
Scopes of dispute
Since Bangladesh does not has sufficient laws to protect Trade Names, a
big number of communities are infringing and passing off big Trade Names
to facilitate their profit by way of trading upon the reputed Trade
Names which constrains big corporate that does not has a corporate
existence in Bangladesh to think off it. As example we can say of
MagDonalds Pvt. Ltd. in Bangladesh which seems to facilitate themselves
from the Trade Name of McDonalds International.
